Our business and marketing partners will use your information in accordance with their own privacy notices.

Information you submit to the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our Store, along with other merchants, and with Shopify.

In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.

To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights with respect to your personal information through the Shopify Privacy Portal.

7. TARGETED ADVERTISING & "SELLING" / "SHARING" DISCLOSURES

Certain state privacy laws (including the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), and similar laws in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states) define "sale" and/or "sharing" of personal information broadly to include making personal information available to third parties in exchange for monetary or other valuable consideration, or for cross-context behavioral advertising purposes.

When we make personal information available to third-party advertising partners (e.g., through cookies, pixels, or data integrations with platforms like Meta/Facebook and Google), this activity may constitute a "sale" or "sharing" under such laws.

Categories of personal information that may be "sold" or "shared" for targeted advertising purposes include:

  • Identifiers (e.g., name, email address, IP address, device identifiers).
  • Internet or other electronic network activity information (e.g., browsing history, search history, interactions with our Site).
  • Commercial information (e.g., products viewed, purchase history).
  • Geolocation data (approximate, inferred from IP address).
  • Inferences drawn from the above categories.

You have the right to opt out of the sale or sharing of your personal information. Please see Section 10 below for details on how to exercise this right.

8. COOKIES AND TRACKING TECHNOLOGIES

8.1 What Are Cookies?

Cookies are small data files placed on your device when you visit a website. We and our third-party partners use cookies and similar tracking technologies (including pixel tags, web beacons, local storage, and SDKs) to collect information about your interactions with our Services.

8.2 Types of Cookies We Use

Strictly Necessary Cookies. Essential for the operation of our Site, including session management, shopping cart functionality, and security. These cookies cannot be disabled without impairing the core functionality of the Site.

Performance & Analytics Cookies. Help us understand how visitors interact with our Site by collecting information about pages visited, traffic sources, and Site performance. This may include tools such as Google Analytics.

Functional Cookies. Enable enhanced functionality and personalization, such as remembering your preferences, language settings, and previously viewed items.

Targeting & Advertising Cookies. Used to deliver relevant advertisements and track the effectiveness of advertising campaigns. These may be set by our advertising partners (e.g., Meta/Facebook Pixel, Google Ads, TikTok Pixel) and may constitute "selling" or "sharing" of personal information under certain state laws (see Section 7).

8.3 Google Analytics

We use Google Analytics to analyze usage of our Site. Google Analytics collects information such as how often users visit the Site, what pages they visit, and what other sites they visited prior. We use the information from Google Analytics to improve our Services. Google Analytics collects the IP address assigned to you on the date you visit the Site, but does not collect your name or other personally identifying information. Google's ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Service and the Google Privacy Policy. You may opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-on.

8.4 Managing Cookies

You can manage your cookie preferences in the following ways:

Browser Settings. Most web browsers allow you to control cookies through their settings. You can set your browser to refuse cookies or to alert you when cookies are being sent. Note that disabling cookies may impair certain features of our Site.

Opt-Out Links:

Global Privacy Control (GPC). We honor Global Privacy Control signals where required by applicable law. If your browser or extension sends a GPC signal, we will treat it as a valid opt-out request for the sale/sharing of personal information linked to that browser. If we are able to associate the device sending the signal to a Shopify account, we will apply the opt-out request to the account as well. To learn more about Global Privacy Control, you can visit https://globalprivacycontrol.org/.

Do Not Track. Other than the Global Privacy Control, we do not recognize other "Do Not Track" signals that may be sent from your web browser or device.

9. DATA RETENTION

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes, or enforce other applicable contracts and policies. General retention periods include:

Account Information. Retained for as long as your account is active, and for a reasonable period thereafter in case you wish to reactivate your account or as needed to provide Services.

Transaction Records. Retained for a minimum of seven (7) years following the date of the transaction, or such longer period as may be required by applicable tax, accounting, or other laws.

Marketing Data. Retained until you unsubscribe or request deletion, plus a reasonable wind-down period.

Cookie Data. Retained for the duration specified in the applicable cookie, generally ranging from session-based to twenty-four (24) months.

Customer Support Records. Retained for a period of five (5) years following the resolution of your inquiry.

Communications. Retained for as long as necessary to fulfill the purpose of the communication and to comply with legal obligations.

When personal information is no longer needed for any of the purposes described above, we will securely delete or anonymize it in accordance with applicable law.

10. YOUR RIGHTS AND CHOICES

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances, and in certain cases, we may decline your request as permitted by law.

10.1 Right to Access / Know

You may have a right to request access to personal information that we hold about you, including the categories of personal information collected, the sources from which it was collected, the purposes for which it was collected, the categories of third parties to whom it was disclosed, and the specific pieces of personal information collected about you.

10.2 Right to Delete

You may have a right to request that we delete personal information we maintain about you, subject to certain exceptions provided by applicable law (e.g., if the information is necessary to complete a transaction, detect security incidents, comply with legal obligations, or exercise or defend legal claims).

10.3 Right to Correct

You may have a right to request that we correct inaccurate personal information we maintain about you.

10.4 Right of Portability

Depending on where you reside, you may have a right to opt out of the "sale" or "sharing" of your personal information, or to opt out of the processing of your personal information for purposes considered to be "targeted advertising," as defined in applicable privacy laws. To exercise this right:

  • Click "Do Not Sell or Share My Personal Information" on our website (where available).
  • Submit a request via email to contact.paleste@gmail.com.
  • Enable the Global Privacy Control (GPC) signal in your browser.

Please note that if you visit our website with the Global Privacy Control opt-out preference signal enabled, depending on where you are, we will automatically treat this as a request to opt out for the device and browser that you use to visit the website. If we are able to associate the device sending the signal to a Shopify account, we will apply the opt-out request to the account as well.

10.6 Right to Limit Use of Sensitive Personal Information

If we collect sensitive personal information (as defined under applicable law), you have the right to limit our use and disclosure of such information to that which is necessary to perform the services or provide the goods reasonably expected by you.

10.7 Managing Communication Preferences

We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you or by contacting us at contact.paleste@gmail.com. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

If you have opted in to receive SMS marketing messages, you may opt out at any time by replying STOP to any marketing text message or by contacting us at contact.paleste@gmail.com.

10.8 Rights for UK and European Economic Area (EEA) Residents

If you reside in the United Kingdom or European Economic Area, and subject to exceptions and limitations provided by local law, you may exercise the following rights in addition to the rights outlined above:

Objection to Processing and Restriction of Processing. You may have the right to ask us to stop or restrict our processing of personal information for certain purposes.

Withdrawal of Consent. Where we rely on consent to process your personal information, you have the right to withdraw this consent at any time. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.

10.9 How to Exercise Your Rights

You may exercise any of these rights where indicated on the Services or by contacting us using the contact details provided below. To learn more about how Shopify uses your personal information and any rights you may have, including rights related to data processed by Shopify, you can visit https://privacy.shopify.com/en.

We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. Verification may require you to provide your name, email address, order number, or other information that matches information already in our records.

In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof that you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

We will respond to your request in a timely manner as required under applicable law, generally within forty-five (45) calendar days of receipt. If we require additional time (up to an additional 45 days), we will inform you of the reason and extension period in writing.

10.10 Right to Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge you different prices, provide a different level or quality of service, or suggest that you will receive a different price or quality of goods or services for exercising your rights.

10.11 Appeal Process

If we decline to take action regarding your request, you may appeal that decision by contacting us at contact.paleste@gmail.com with the subject line "Privacy Rights Appeal." We will respond to your appeal within the timeframe required by applicable law. If your appeal is denied, you may contact your state's Attorney General or your local data protection authority to submit a complaint.
