1. AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement between you and Paleste , governing your access to and use of the website paleste.store, including any subdomains, mobile-optimized versions, and any related applications, services, features, content, and functionality offered on or through the Site .
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING OUR SERVICES. By accessing the Site, browsing any page, creating an account, adding items to your cart, placing an order, subscribing to our communications, or otherwise using any of our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy (available at https://paleste.store/policies/privacy-policy) and Return & Refund Policy (available at https://paleste.store/policies/refund-policy), each of which is incorporated herein by reference.

4. ACCOUNT REGISTRATION & SECURITY
4.1 Account Creation
Certain features of our Services may require you to create a customer account. When creating an account, you agree to:

We reserve the right to disable any user account at any time, in our sole discretion, for any or no reason, including if, in our opinion, you have violated any provision of these Terms.
4.3 Account Termination by You
You may delete your account at any time by contacting us at contact.paleste@gmail.com. Upon deletion, your account information will be handled in accordance with our Privacy Policy.
4.4 Guest Checkout
You are not required to create an account to make a purchase. Guest checkout is available; however, creating an account allows you to track orders, view order history, and manage your preferences more easily.
5. PRODUCTS & SERVICES
5.1 Product Descriptions
We make every effort to display and describe our Products as accurately as possible. However, we do not warrant that Product descriptions, photographs, images, colors, dimensions, specifications, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free. Product images are for illustrative purposes only and may differ slightly from the actual product due to monitor display settings, photographic lighting, or other variables. If a Product you receive differs materially from its description on the Site, your sole remedy is to return it in accordance with our Return & Refund Policy.
5.2 Product Availability
All Products are subject to availability. We reserve the right to discontinue any Product at any time without notice. Such modifications may include changes to packaging, included accessories, color, or minor design features, provided that the core functionality of the Product remains materially the same.
5.4 Product Use & Safety
You agree to use all Products in accordance with their intended purpose and any instructions, warnings, or guidelines provided with the Product. Paleste is not responsible for any damage, injury, or loss caused by improper use, misuse, modification, or failure to follow Product instructions. Wireless chargers should be used only with compatible devices and in accordance with the manufacturer's guidelines. Do not use Products near water, excessive heat, or flammable materials. Paleste is not responsible for damage to your devices caused by use of our Products, except to the extent such damage results from a defect in the Product.
6. PRICING, AVAILABILITY & ERRORS
6.1 Pricing
All prices displayed on the Site are listed in United States Dollars (USD) unless otherwise stated. Prices are subject to change at any time without notice, except that price changes will not affect orders that have already been confirmed.
Prices displayed on the Site do not include:
- Sales tax, which will be calculated and added at checkout where required by applicable law.
- Shipping charges, which will be calculated and displayed at checkout based on your shipping address and selected shipping method (if applicable).
- Customs duties, import taxes, or international fees, which may apply to international orders and are the sole responsibility of the customer.
6.2 Pricing Errors
Despite our best efforts, errors in pricing, product descriptions, or product availability may occasionally occur. In the event that a Product is listed at an incorrect price or with incorrect information due to a typographical error, system glitch, or other error:
- We reserve the right to refuse or cancel any order placed for the incorrectly priced Product, regardless of whether the order has been confirmed and/or your payment has been processed.
- If your payment has already been charged, we will issue a full refund to your original payment method.
- We will attempt to notify you of the cancellation via email at the email address associated with your order.
- We are under no obligation to sell any Product at an erroneously listed price.
6.3 Price Matching
We do not offer price matching with any third-party retailers, marketplaces, or competitors.
6.4 Currency
All transactions are processed in United States Dollars (USD). If you are paying from an account denominated in a different currency, your bank or payment provider may apply currency conversion fees, exchange rate markups, or additional charges, for which Paleste is not responsible.
7. ORDERS & ORDER ACCEPTANCE
7.1 Order Placement
When you place an order through the Site, you are making an offer to purchase the Product(s) in your order. All orders are subject to acceptance by us.
7.2 Order Confirmation
After you submit your order, you will receive an automated order confirmation email acknowledging that we have received your order. This order confirmation does not constitute acceptance of your order. It is merely an acknowledgment that your order has been received.
7.3 Order Acceptance
An order is considered accepted only when we ship the Product(s) or send a separate shipping confirmation email with tracking information. We reserve the right, at our sole discretion, to accept or decline any order, in whole or in part, for any reason, including but not limited to:
- Product unavailability or stock shortages.
- Errors in pricing, product descriptions, or product information.
- Suspected fraudulent, unauthorized, or illegal activity.
- Inability to verify your identity or payment information.
- Failure to meet eligibility requirements.
- Orders that appear to be placed by dealers, resellers, or distributors.
- Limitations on quantities available for purchase.
7.4 Order Limitations
We reserve the right to limit the quantity of any Product purchased per person, per household, per order, or per account. We may also restrict or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. If we cancel or limit your order, we will attempt to notify you using the email address and/or phone number provided at the time the order was placed.
7.5 Order Cancellations by Us
We reserve the right to cancel any order at any time prior to shipment for any reason. If we cancel your order, we will notify you via email and issue a full refund to your original payment method. We will not be liable to you or any third party for any cancellation.

8. PAYMENT TERMS
8.1 Accepted Payment Methods
We accept the following payment methods through our Site:
- Shopify Payments (Visa, Mastercard, American Express, Discover, and other accepted credit and debit cards)
- PayPal
- HitPay (including applicable payment methods available through the HitPay platform)
We may add or remove payment methods at any time without notice.
8.2 Payment Authorization
By submitting an order and providing your payment information, you represent and warrant that:
- You are the authorized user of the payment method used.
- The payment information you provide is accurate and complete.
- You authorize us (and our payment processors) to charge the full order total (including product price, applicable taxes, and shipping charges) to your chosen payment method.
8.3 Payment Processing
All payment transactions are processed securely through our third-party payment processors: Shopify Payments, PayPal, and HitPay. Your payment information is encrypted using industry-standard Secure Socket Layer (SSL) / Transport Layer Security (TLS) technology. We do not store your full credit card number, debit card number, or CVV/security code on our servers. All payment data is handled in accordance with the Payment Card Industry Data Security Standard (PCI-DSS).

8.4 Billing Errors
If you believe there is an error in the amount you were charged, please contact us immediately at contact.paleste@gmail.com with your order number and a description of the billing discrepancy. We will investigate and, if an error is confirmed, correct the charge promptly.
8.5 Sales Tax
We collect and remit sales tax in states and jurisdictions where we are required by law to do so. Applicable sales tax will be calculated and displayed at checkout based on your shipping address and the applicable tax rate at the time of purchase.
8.6 Refunds
All refunds are processed in accordance with our Return & Refund Policy, which is incorporated herein by reference.
9. SHIPPING & DELIVERY
9.1 Shipping Methods & Estimated Delivery Times
We currently offer shipping to addresses within the United States. Estimated shipping times, shipping methods, and associated costs will be displayed at checkout. Delivery estimates are provided for informational purposes only and are not guaranteed. Actual delivery times may vary depending on:
- Your shipping address and geographic location.
- The shipping method selected at checkout.
- Order processing time.
- Carrier transit times and capacity.
- Weather, natural disasters, customs clearance, holidays, or other factors beyond our control.
9.2 Order Processing Time
Orders are typically processed within one to three (1–3) business days after payment confirmation. Business days are Monday through Friday, excluding federal holidays. Please note that processing times are separate from shipping transit times.
9.3 Shipping Carriers
We use reputable third-party shipping carriers to deliver your orders, which may include but are not limited to USPS, UPS, FedEx, DHL, and other carriers. The shipping carrier may vary depending on your location and the shipping method selected.
9.4 Tracking Information
Once your order has shipped, you will receive a shipping confirmation email with a tracking number and a link to track your package. Please allow twenty-four to forty-eight (24–48) hours after receiving your shipping confirmation for tracking information to become active in the carrier's system.
9.5 Risk of Loss & Title
Title to and risk of loss for all Products passes to you upon delivery to the shipping carrier. While we will assist you in resolving issues with lost, stolen, or damaged shipments, we are not liable for any loss, theft, or damage to Products that occurs after the Products have been delivered to the carrier.
9.6 Delivery Issues
- Undeliverable Packages: If a package is returned to us as undeliverable due to an incorrect or incomplete shipping address provided by you, you will be responsible for any reshipping costs. We recommend verifying your shipping address at checkout.
- Lost Packages: If your tracking shows that your package has not been updated for an extended period or appears lost in transit, please contact us at contact.paleste@gmail.com so we can investigate with the carrier and determine the appropriate resolution.
- Stolen Packages: We are not responsible for packages that are confirmed as delivered by the carrier but subsequently stolen from your delivery location. We recommend using a secure delivery address. Depending on the circumstances, we may, at our sole discretion, offer a one-time courtesy replacement or refund, but we are under no obligation to do so.
- Refused Packages: If you refuse delivery of a package, it will be returned to us, and your refund will be processed in accordance with our Return & Refund Policy.
9.7 International Shipping
If international shipping is available, any customs duties, import taxes, brokerage fees, or other charges imposed by your country's government are the sole responsibility of the customer. Paleste has no control over these charges and cannot predict their amount. Please check with your local customs office for more information. We are not responsible for delays caused by customs clearance.
9.8 Shipping Address Accuracy
You are solely responsible for providing a correct and complete shipping address at the time of checkout. Paleste is not liable for orders delivered to incorrect addresses as a result of errors in the shipping information provided by you. If you realize you have entered an incorrect shipping address, please contact us immediately at contact.paleste@gmail.com. We will make reasonable efforts to update the shipping address before the order is shipped, but we cannot guarantee that changes can be made once an order has been submitted for processing or shipped.
10. RETURNS, REFUNDS & EXCHANGES
All returns, refunds, and exchanges are governed by our Return & Refund Policy, which is available at https://paleste.store/policies/refund-policy and is incorporated herein by reference in its entirety.
By placing an order through our Site, you acknowledge that you have read, understood, and agree to the terms and conditions of our Return & Refund Policy, including but not limited to:
- A thirty (30) calendar day return window from the date of delivery.
- Free return shipping for eligible returns within the continental United States.
- Requirement to obtain a Return Merchandise Authorization (RMA) before returning any item.
- Refunds issued to the original payment method (Shopify Payments, PayPal, or HitPay).
- Specific conditions and exclusions regarding eligibility for returns and refunds.
11. PROMOTIONS, DISCOUNTS & COUPON CODES

11.2 Coupon Code Terms
- Each coupon code may only be used once per customer (unless otherwise stated).
- Coupon codes must be entered at checkout to be applied. We cannot retroactively apply discount codes to orders that have already been placed.
- Coupon codes may have expiration dates, minimum purchase requirements, or product/category restrictions, which will be specified at the time the code is issued.

You may not use such marks without the prior written permission of Paleste. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.
12.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site solely for your personal, non-commercial use (i.e., browsing products, making purchases for personal use, and accessing your account). This license does not include:

- The User Content does not infringe, violate, or misappropriate any third party's intellectual property rights, privacy rights, publicity rights, or any other rights.
- The User Content does not contain any false, misleading, defamatory, obscene, harassing, threatening, or otherwise unlawful or objectionable material.
- The User Content does not contain any viruses, malware, or other harmful code.
- You are at least eighteen (18) years of age.

To the fullest extent permitted by applicable law, you release Paleste from any and all claims, demands, damages (actual and consequential), losses, and liabilities of every kind and nature, known and unknown, arising out of or in any way connected with your use of or interaction with any Third-Party Services.

- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
- WARRANTIES THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, VIRUS-FREE, OR AVAILABLE AT ALL TIMES.

PALESTE DOES NOT MANUFACTURE THE PRODUCTS SOLD ON THE SITE. Products are sourced from third-party suppliers and manufacturers. While we make every effort to work with reputable suppliers and ensure product quality, we disclaim all warranties made by manufacturers or suppliers to the maximum extent permitted by law. Any warranties provided by the manufacturer (if applicable) are between you and the manufacturer, and Paleste shall have no liability in connection therewith.
WIRELESS CHARGING PRODUCTS ARE DESIGNED TO WORK WITH COMPATIBLE DEVICES ONLY. Paleste does not warrant that our Products will be compatible with your specific device(s). It is your responsibility to verify device compatibility before purchasing. Paleste is not responsible for any damage to your devices, data loss, or other issues arising from use of our Products, except to the extent caused by a manufacturing defect in the Product.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PALESTE, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, ASSIGNS, SUPPLIERS, LICENSORS, OR SERVICE PROVIDERS (COLLECTIVELY, THE "PALESTE PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, BUSINESS, SAVINGS, GOODWILL, OR ANTICIPATED SAVINGS;
- LOSS OF DATA OR DATA BREACH;
- PERSONAL INJURY OR PROPERTY DAMAGE;
- LOSS OF USE OF ANY DEVICE OR EQUIPMENT;
- COST OF SUBSTITUTE GOODS OR SERVICES;
ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, SERVICES, OR PRODUCTS, HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE), EVEN IF THE PALESTE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
18.2 Aggregate Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE PALESTE PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, SERVICES, OR PRODUCTS SHALL NOT EXCEED THE GREATER OF:
(A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO PALESTE FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE DATE THE CLAIM AROSE; OR
(B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
18.3 Essential Basis
THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN PALESTE AND YOU. THE SITE, SERVICES, AND PRODUCTS WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS.
18.4 Jurisdictional Limitations
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, THE PALESTE PARTIES' LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
19. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Paleste and the Paleste Parties from and against any and all claims, actions, suits, proceedings, liabilities, obligations, losses, damages, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:
- Your use of or access to the Site, Services, or Products.
- Your violation of these Terms or any applicable law, regulation, or third-party right.
- Your User Content or any content you submit, post, or transmit through the Site.
- Any dispute between you and a third party arising from your use of the Site, Services, or Products.
- Your negligence, willful misconduct, fraud, or misrepresentation.
- Your breach of any representation or warranty contained in these Terms.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate fully with our defense of such claims. You agree not to settle any such matter without our prior written consent.
This indemnification obligation will survive the termination of these Terms and your use of the Site and Services.
20. DISPUTE RESOLUTION & BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
20.1 Informal Resolution First
Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Site, Services, or Products ("Dispute") informally by contacting us at contact.paleste@gmail.com with a written description of the Dispute, including your name, order number, and the relief you seek ("Informal Dispute Resolution Notice"). We will attempt to resolve the Dispute informally within sixty (60) calendar days from the date we receive your Informal Dispute Resolution Notice. If the Dispute is not resolved within this sixty (60) day period, either party may then proceed to binding arbitration as set forth below.
20.2 Binding Arbitration
IF A DISPUTE CANNOT BE RESOLVED INFORMALLY, YOU AND PALESTE AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, SERVICES, OR PRODUCTS SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT, except that:
- Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights; and
- Claims that qualify may be brought in small claims court in Travis County, Texas, provided the claim remains in small claims court and proceeds on an individual (non-class, non-representative) basis.
20.3 Arbitration Rules & Forum
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at https://www.adr.org/consumer. If the AAA is unable or unwilling to administer the arbitration, the parties shall agree on an alternative arbitration provider. If the parties cannot agree, a court of competent jurisdiction shall appoint an arbitration provider.
20.4 Arbitration Procedures
- The arbitration shall be conducted by a single, neutral arbitrator.
- The arbitration may be conducted in person, by telephone, via video conference, or based solely on written submissions, as determined by the arbitrator.
- The seat of arbitration shall be Travis County, Texas, unless the parties agree otherwise or the arbitrator determines that a different location is more appropriate.
- The arbitrator shall apply the substantive laws of the State of Texas (without regard to conflict of law principles) and applicable federal law, consistent with the Federal Arbitration Act (9 U.S.C. §§ 1–16).
- The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this arbitration agreement.
- The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
20.5 Costs & Fees
Payment of all filing, administration, and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules and applicable fee schedules. If your claim is for less than $10,000, Paleste will reimburse your filing fees and may pay the arbitrator's fees, unless the arbitrator determines the claim is frivolous. Each party shall bear its own attorneys' fees and costs, unless the arbitrator awards attorneys' fees and costs to the prevailing party where authorized by applicable law.
20.6 Opt-Out Right
You have the right to opt out of this binding arbitration provision. To opt out, you must send a written notice to contact.paleste@gmail.com within thirty (30) calendar days of first accepting these Terms. Your opt-out notice must include:
- Your full legal name.
- Your mailing address.
- Your email address associated with your Paleste account (if applicable).
- A clear statement that you wish to opt out of the arbitration provision.
If you opt out, neither you nor Paleste will be required to arbitrate Disputes, and both parties retain the right to resolve Disputes in court. Opting out of arbitration will not affect any other provisions of these Terms.
20.7 Survival
This arbitration agreement shall survive the termination of these Terms, the closure of your account, and/or the cessation of your use of the Site and Services.
21. CLASS ACTION WAIVER
YOU AND PALESTE AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER TYPE OF REPRESENTATIVE PROCEEDING.
Neither you nor Paleste shall be entitled to join or consolidate claims with those of any other person or entity, or to arbitrate or litigate any Dispute in a representative capacity, including but not limited to as a representative member of a class or in a private attorney general capacity.
The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THE ARBITRATION PROVISION IN SECTION 20 SHALL BE NULL AND VOID (BUT ALL OTHER PROVISIONS OF THESE TERMS SHALL REMAIN IN EFFECT), AND THE DISPUTE SHALL BE DECIDED BY A COURT OF COMPETENT JURISDICTION.
22. GOVERNING LAW & JURISDICTION
These Terms and any Dispute arising out of or relating to these Terms, the Site, Services, or Products shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law principles, except to the extent preempted by the Federal Arbitration Act or other applicable federal law.
To the extent that any Dispute is not subject to arbitration (as set forth in Section 20), or if the arbitration provision is found unenforceable, you and Paleste agree that any such Dispute shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you and Paleste irrevocably consent to the exclusive personal jurisdiction and venue of such courts.
23. FORCE MAJEURE
Paleste shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause that is beyond our reasonable control, including but not limited to:
- Acts of God (e.g., earthquakes, floods, hurricanes, tornadoes, wildfires).
- Epidemics, pandemics, or public health emergencies.
- War, terrorism, insurrection, riots, civil unrest, or armed conflict.
- Government actions, sanctions, embargoes, regulations, or orders.
- Strikes, lockouts, labor disputes, or shortages of labor.
- Supply chain disruptions, raw material shortages, or manufacturing delays.
- Failures or disruptions of transportation, telecommunications, internet services, or utility services.
- Cyberattacks, data breaches, or system failures.
- Shipping carrier delays, losses, or disruptions.
- Any other event beyond our reasonable control.
In the event of a force majeure event, our performance under these Terms will be suspended for the duration of the event, and the time for performance will be extended by a period equal to the duration of the delay. We will make reasonable efforts to mitigate the impact of the force majeure event and to resume performance as soon as practicable.
24. ELECTRONIC COMMUNICATIONS & CONSENT
24.1 Electronic Communications
When you use the Site, create an account, place an order, or send emails or other communications to us, you are communicating with us electronically. You consent to receive communications from us electronically, including via email, text message (if you opt in), push notification, or by posting notices on the Site.
24.2 Agreement to Electronic Records

26. TERMINATION & SUSPENSION
26.1 Termination by Paleste
We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to the Site and Services, and/or to deactivate or delete your account, at any time and for any or no reason, with or without notice, including but not limited to:
- Violation of these Terms or any other policies referenced herein.
- Suspected fraudulent, abusive, or illegal activity.
- Conduct that may create liability for Paleste.
- Extended periods of inactivity.
- Upon request by law enforcement or other government agencies.
26.2 Effect of Termination
Upon termination:
- Your right to access and use the Site and Services will immediately cease.
- Any pending orders may be cancelled (with a full refund if payment has been processed).
- We may delete your account information, subject to our obligations under our Privacy Policy and applicable data retention laws.
- All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions (Section 12), warranty disclaimers (Section 17), limitation of liability (Section 18), indemnification (Section 19), dispute resolution (Section 20), class action waiver (Section 21), governing law (Section 22), and any other provision that is intended to remain effective after termination.
26.3 Termination by You
You may terminate your agreement with us at any time by discontinuing your use of the Site and Services and, if you have an account, by requesting account deletion at contact.paleste@gmail.com.
27. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such provision shall be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, or shall be severed from these Terms if modification is not possible, and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of such provision in any other jurisdiction.
28. WAIVER
The failure of Paleste to enforce or exercise any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Paleste. No waiver of any breach or default shall be a waiver of any subsequent breach or default, nor shall a waiver of one provision be deemed to constitute a waiver of any other provision.
29. ASSIGNMENT
You may not assign, delegate, or transfer your rights or obligations under these Terms, in whole or in part, without the prior written consent of Paleste. Any attempted assignment or transfer in violation of this provision shall be null and void. Paleste may assign, delegate, or transfer these Terms, in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.
30. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Return & Refund Policy, and any other policies, terms, or agreements expressly incorporated by reference herein, constitute the entire agreement between you and Paleste with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site, Services, and Products.
No statement, representation, warranty, covenant, or agreement of any kind not expressly set forth in these Terms shall affect, or be used to interpret, change, or restrict, the express terms and provisions of these Terms.
31. MODIFICATIONS TO THESE TERMS
We reserve the right to modify, amend, or update these Terms at any time, at our sole discretion, without prior notice except as required by applicable law. We will indicate changes by updating the "Last Updated" date at the top of this page and, for material changes, we may post a notice on the Site or send you an email notification.
